We all know Kris Humphires and Kim Kardashian have been separated for over a year, but that doesn’t really matter in the state of California. In Cali the law says a husband of a pregnant woman is PRESUMED to be the father!

Which means Kris Humphries has the right to walk in the delivery room and be like, “I’m the baby daddy!” Now I don’t think Humphries would do a jerk thing like that but then again…he might!

If he were to claim the kid, Kim and Kanye would have to present “clear and convincing evidence” to a judge that Kanye is the father.

I mean we all know Kanye is…but unfortunately that’s how the law works.

So if this issue does come up, I don’t think it would be that hard to prove that Kanye is the baby’s dad.
